Terms and conditions

These terms and conditions ("Terms") govern your access to and use of affordablegetaways.net, book.affordablegetaways.net and any related pages or services operated by Affordable Getaways ("we", "us", "our"), together the "Site", and any booking you make through the Site. By accessing the Site or completing a booking you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Our role

We act solely as an agent for the suppliers of the travel services offered on the Site, including airlines, hotels and other accommodation providers, tour and activity operators, transfer companies and consolidators (each a "Supplier"). We are not a Supplier and we do not own, operate or control any means of transport, accommodation or activity.

Bookings on the Site are self-service. You select, review and complete your own booking. When a booking is confirmed, a contract is formed directly between you and the relevant Supplier, and that contract is governed by the Supplier's own terms and conditions, which are made available to you before you pay and which you should read. Where a booking comprises services from more than one Supplier, a separate contract is formed with each of them.

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into binding contracts. If you book for other travellers, you represent that you are authorised to act on their behalf and that you have brought these Terms and the applicable Supplier terms to their attention.

3. Prices, taxes and payment

Prices are quoted in the currency selected on the Site and, unless expressly stated otherwise on the relevant booking page, include applicable taxes and mandatory fees. Certain charges can only be collected locally by the Supplier, including resort fees, tourist or city taxes, security deposits, and charges for optional extras. Where such charges apply, they are disclosed before payment.

Prices and availability are live and are only fixed at the moment a booking is confirmed. If a Supplier withdraws availability or corrects a price before your booking is confirmed, we will notify you and you may proceed at the corrected price or cancel at no charge.

Payment is processed by our payment provider at the time of booking. We do not receive or store full payment card numbers. Where a Supplier requires payment directly, that will be stated at the time of booking.

In the event of an obvious pricing error, meaning a price so far below the prevailing market rate that a reasonable person would recognise it as a mistake, we and the Supplier reserve the right to decline or cancel the booking and refund any amount paid in full.

4. Changes, cancellations and refunds

Change and cancellation rights are determined by the Supplier's fare rules or rate conditions applicable to your booking, which are displayed before payment. Many discounted airfares and accommodation rates are non-refundable and non-changeable, in whole or in part.

Where you wish to change or cancel, you must do so through the booking management provided by the Supplier or through the Site, subject to the applicable conditions. Where a refund is due, it is issued to the original method of payment. The time taken for a refund to appear depends on the Supplier and on your card issuer or bank and is outside our control.

Where a Supplier cancels or materially changes a service, your rights and remedies are those provided by the Supplier's terms and by applicable law, including, where relevant, air passenger rights legislation. We will assist you in pursuing them.

5. Your responsibilities

• Traveller details. Names must be entered exactly as they appear on the passport or government-issued identification with which each traveller will travel. Corrections after ticketing may incur charges or may not be possible, and the cost of a name correction or reissue is your responsibility.
• Travel documents. You are responsible for holding a valid passport and for obtaining all visas, transit visas, permits, and health documentation required for every country on your itinerary, including countries of transit. Entry requirements are set by governments and can change without notice. Denied boarding or denied entry for want of correct documentation is not refundable.
• Check-in and timings. You are responsible for reconfirming schedules and for presenting yourself within the check-in and boarding windows set by the Supplier.
• Accuracy of contact details. You must provide a monitored email address so that Supplier notifications reach you.

6. Travel insurance

We strongly recommend that you obtain comprehensive travel insurance covering, at a minimum, medical expenses and repatriation, cancellation and curtailment, and baggage. Insurance is not included in the prices shown unless expressly stated on the booking page.

7. Limitation of liability

We are responsible for arranging your booking with reasonable skill and care in our capacity as agent. We are not liable for the acts, omissions, insolvency, negligence or default of any Supplier, nor for the quality, safety or fitness for purpose of any service supplied by a Supplier.

We are not liable for any failure or delay caused by circumstances beyond our reasonable control, including acts of God, severe weather, natural disaster, epidemic or pandemic, war, civil unrest, terrorism, industrial action, airport or airspace closure, air traffic control decisions, or Supplier schedule changes.

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with a booking shall not exceed the total service fees we received in respect of that booking. We are not liable for indirect or consequential loss, including loss of enjoyment, loss of profit or loss of opportunity.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

8. Complaints

If a problem arises during travel, you must report it to the Supplier at the time so that the Supplier has a reasonable opportunity to remedy it. Failure to do so may affect your rights. You should then contact us at hello@affordablegetaways.net, with your booking reference, and we will take the matter up with the Supplier on your behalf.

9. Acceptable use of the Site

You agree not to use the Site for any unlawful purpose, not to make speculative, false or fraudulent bookings, and not to use any automated system to access, scrape, monitor or copy the Site or its content without our prior written consent. All content on the Site, including text, imagery, layout and code, is protected by intellectual property rights and may not be reproduced without permission, except that photographic material published under a Creative Commons licence is credited on our photo credits page and may be used under the terms of that licence.

10. Communications

By making a booking you agree that we and the Supplier may contact you by email regarding that booking, including confirmations, changes and operational notices, as these are transactional communications necessary to the service. Text messages are sent only where you have given express written consent, and are governed by our messaging terms.

11. Privacy

Personal information is handled in accordance with our privacy policy, which forms part of these Terms.

12. Amendments and severability

We may amend these Terms from time to time. The version in force at the time your booking is confirmed governs that booking. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force and effect.

13. Governing law

These Terms and any dispute arising out of or in connection with them are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions, and the courts of that State shall have jurisdiction, save where mandatory consumer protection law grants you the right to bring proceedings in the courts of your place of residence.
